Conditions of Entry

Information on how to enter, the prizes and rules for redeeming the prizes form part of the conditions of entry for the Promotion. Participation in the Promotion is deemed acceptance of these conditions of entry (Conditions) and any other notices referenced herein.

    In these Conditions:

    (a) the term "you" refers to the person entering the Promotion; and
      (b) the term “Promoter” refers to ABB Australia Pty Limited ACN 68003337611 of 601 Blackburn Road, Notting Hill, VIC 6138 as the promoter for this Promotion.


      1.1 Entry to the Promotion is open to residents of Australia only who are aged 18 years or older at the date of entry and who otherwise meet the criteria set out in these Conditions.

      1.2 Employees and officers of the Promoter, the agencies associated with this Promotion and their immediate family members are not eligible to enter the Promotion or to be awarded any prizes in connection with the Promotion.

      1.3 The entry period for the Promotion:

        (a) commences at 12pm AEST on Monday 10 December 2012 and

        (b) closes at 12pm AEST on Thursday 17 January 2013,

        (“Entry Period”)

        unless the Promotion ends earlier in accordance with these Conditions.

      1.4 To enter the Promotion, you must, during the Entry Period:

        (a) Be invited by the promoter through receiving the LVP e-Newsletter via email.

        (b) Follow the instructions on the Competition Page and register your details including, without limitation, name and e-mail address. Failure to provide accurate and complete information will render the entry invalid

        (c) In the space provided, answer ALL questions correctly.

          (d) Submit your answers to the Promoter by clicking the “Contact” Tab in the Competition page
        1.5 You may submit a maximum of one entry to the Promotion. Any entries in addition to this will be automatically disqualified and the Promoter may, in its absolute discretion, disqualify your participation in the Promotion.
          1.6 There will be one prize(s) awarded in connection with this Promotion, comprised of the following components:
              (a) One ABB Chronograph Sports Watch valued at A$64.90 RRP inc GST.

              1.7 The total prize pool value is AU$64.90
                1.8 All valid entries received during the Entry Period will be entered into the final prize draw to be conducted by the Promoter at ABB Australia, 601 Notting Hill, VIC 6138 at 12pm AEST on Friday 18 January 2013.

                1.9 All prize winners will be notified by telephone/e-mail within 2 business days of the prize draw, using the contact details provided in connection with the entry.
                  1.10 In the event that the prize winner fails to claim his or her prize by 12pm AEST on Thursday 18 April, 2013

                    (a) the original prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit; and

                    (b) the Promoter will conduct a redraw in respect of that prize at 1pm AEST on Thursday 18 April, 2013 at the same location as the original draw. Disposal of any unclaimed prizes may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.

                    The unclaimed prize draw winner will be notified by email within 2 business days of the redraw, using the contact details provided by that person when entering the Promotion.

                  1.11 The Promotion is authorised under:

                    (a) NSW Permit No. LTPS/12/10751

                    (b) ACT Permit No. ACT TP 12/04902


                  2.1 By submitting an entry into this Promotion, you warrant that you have read, understand and agree to be bound by these Conditions.
                    2.2 The Promoter reserves the right, at any time, to verify the validity of entries and participants in the Promotion (including an entrant’s identity, age and place of residence). The Promoter may, at its absolute discretion, declare any or all entries made by you to be invalid if you fail to establish their entitlement to enter the Promotion to the Promoter's satisfaction
                      2.3 Any person who is discovered to have used or attempted to use more than one name in entering the Promotion will be disqualified from participating in the Promotion and/or redeeming a prize.
                        2.4 Should your contact details change during the Entry Period, it is your responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
                          2.5 Inaudible, incomplete, incomprehensible or late entries (whichever is applicable) will not be eligible and will be disqualified. The Promoter reserves the right to disqualify any entry which in the opinion of the Promoter includes any content which may be unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter or which may otherwise infringe the intellectual property rights of a third party (in the reasonable opinion of the Promoter).
                            2.6 Entries via email, SMS or any other electronic method are deemed to be received at the time of receipt into the Promoter’s database not at the time of transmission by the entrant.
                              2.7 It is a condition of entry that the Promoter has the right to publicise, broadcast and communicate to the public the names, characters or likenesses of any entrants for any promotion or matter incidental to the Promotion.
                                2.8 Entrants may be required by the Promoter to participate in photo, recording, video and/or film session(s) (the “publicity materials”) and acknowledge that the Promoter has the right to use such publicity materials in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that person advises the Promoter at the time of entering the Promotion that he/she wishes to retain his/her anonymity.

                                2.9 By entering this Promotion all entrants:

                                  (a) assign to the Promoter all rights including present and future copyright in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;

                                  (b) agree not to assert any moral rights in respect of their entry and the publicity materials (wherever and whenever such rights are recognised) against the Promoter, its assigns, licensees and successors in title; and

                                  (c) undertake to the Promoter that their entry is not in breach of any third party intellectual property rights.

                                2.10 All prize values are the recommended retail value as provided by the supplier, are in Australian dollars and are correct at the time of publication of these Conditions. The Promoter takes no responsibility for variations in the prize value.
                                  2.11 No other costs will be included and all expenses (including, but not limited to, the costs of transport to and from a prize venue and meals), other than those specifically referred to in the Promotion-specific Terms & Conditions set out above, will be at each winner’s and (if applicable) their accompanying guest’s cost.
                                    2.12 All prizes are subject to availability, non transferable and non exchangeable, are subject to the standard terms and conditions applicable to such prizes and/or travel and must be used on any dates specified in these Conditions, by the Promoter and/or the prize provider and are not redeemable for cash unless cash is specified.
                                      2.13 If a prize winner does not take any element of a prize at the time specified by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that prize or any part of it.
                                        2.14 In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
                                          2.15 Entrants proposing to redeem prizes involving or participate in the Promotion where it involves travel or participation in an activity may, at the absolute discretion of the Promoter, first be required to execute a Deed of Release and Indemnity in a form prescribed by the Promoter in order to participate further in the Promotion and/or redeem the prize.
                                            2.16 Any tax payable as a result of a prize being awarded or received will be the responsibility of the winner. Winners should seek independent financial advice prior to accepting a prize if this is a concern.
                                              2.17 All decisions and actions of the Promoter relating to the Promotion and/or redemption of the prizes are exercised accordingly at its absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.
                                                2.18 In the case of any act, agent or event which prevents or hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, the Promoter may, in its absolute discretion but subject to the approval of those authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend the Promotion cancel the Promotion.
                                                  2.19 The Promoter will not award the prize if the Promotion is terminated for whatever reason.
                                                    2.20 To the extent permitted by law (including, without limitation, the consumer guarantee provisions of the Competition and Consumer Act 2010) the Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or services awarded as a prize.

                                                    2.21 To the maximum extent permitted by law, the Promoter excludes all liability (including negligence) arising out of or in connection with:

                                                      (a) inaccurate / incorrect transcription of entry information;

                                                      (b) purported entries that are not received for any reason, including because or any transmission errors or if they are misdirected or stolen;

                                                      (c) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;

                                                      (d) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;

                                                      (e) any variation in the Conditions;

                                                      (f) any theft, unauthorised access or third party interference in any part of the Promotion or the prize(s);

                                                      (g) electronic or human error which may occur in the administration of the Promotion or the prize(s);

                                                      (h) any loss or damage (including loss of opportunity) suffered or sustained, to person or property and including, but not limited to, direct, indirect, special or consequential loss (including economic loss) by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a prize winner;

                                                      (i) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this Promotion.

                                                      2.22 The personal information supplied by you when entering this Promotion will be used by the Promoter in accordance with its Privacy Policy. The Promoter may disclose such information to third parties, including, but not limited to, prize suppliers, agencies associated with the Promotion, and to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter and third parties to whom the Promoter provides this information may, for an indefinite period unless otherwise advised, use the information for announcing prize winners (name and suburb/postcode only) and for direct marketing, research and debt collection purposes. Participants in the Promotion should direct any request to access, update or correct information to the Promoter. By participating in the Promotion, you agree to use of your information in accordance with the Privacy Policy accessible at ABB Australia.
